TERMS AND CONDITIONS

Car Rental Requirements:

1. Car rental requirements must be provided on the rental date. Failure to provide the necessary requirements will result in the forfeiture of your reservation.
2. Our representative may request an additional identification card for security purposes.
3. The minimum age requirement for renting a vehicle is 21 years old, except for Vans and SUVs, which require a minimum age of 30 years old.
4. A valid physical driver's license is mandatory.
5. Full rental payment must be made upon pickup.
6. A security deposit is required and can be made using a Credit Card, GCash, or Maya.

Foreign Driver's License:

A passport with an arrival stamp of not more than 90 days is required for foreign driver's licenses.

Local Driver's License:

1. An original proof of billing or company ID is required for local driver's licenses.
2. An additional valid ID is also necessary.

Security Deposit Amount:

The security deposit amount varies depending on the type of vehicle, ranging from P2,000 to P35,000.

Rental Hours:

1. A day's rental is equivalent to 24 hours. Excess hours will be charged at 1/6 of the daily rate.
2. If the rental period exceeds 6 hours (up to 24 hours), the daily rate will be applied.
3. Saferide Car Rental will make every effort to retain the same car and chauffeur for weekly or long period rentals. However, we reserve the right to substitute any other similar category car and chauffeur based on the service's requirements (e.g., car due for check-up or availability).

Fuel Policy:

The fuel policy is "Full to Full." The renter must return the vehicle with a full tank of fuel. If the vehicle is not returned with a full tank, the renter will be responsible for refueling costs.

Additional Costs:

Gasoline, parking fees, traffic violations, and toll fees are the responsibility of the renter.

Late Payment:

1. The renter shall be liable to pay interest at the rate of twenty-four percent (24%) per annum in case of a delay in payment of rental fees within the provided period.
2. Upon the immediate return of the vehicle, if the matter is referred to a lawyer, the renter agrees to pay attorney's fees at the rate of 25% of the amount due, with a minimum fee of P5,000.00, in addition to the cost of the lawsuit.

Venue for Disputes:

In case of a suit arising from or related to the agreement, the agreed venue shall be the place where the rental transaction initially took place, i.e., the Saferide Car Rental branch/office where the unit was rented from.

Prohibited Uses of the Vehicle:

The vehicle shall not be operated under the following circumstances:

1. Traveling to mountain trails or other areas where roads are impassable for cars or vans.
2. Engaging in high-speed or negligent driving that can cause accidents, damage, or breakdowns.
3. Carrying passengers, property, or other personal belongings or goods for commercial purposes.
4. Transporting items with foul smells or substances that can stain the interior of the vehicle.
5. Used by individuals with pending cases, charges, or convictions related to crimes against public property or carrying persons with dubious character.
6. Propelling or towing other vehicles, trailers, or heavy objects with or without wheels.
7. Operated by individuals with symptoms or previous records of mental illness or under the influence of alcohol or drugs.
8. Transporting goods in violation of customs rules and regulations or engaging in any other illegal activities.
9. Allowing any person other than the renter or declared driver in this agreement to drive the vehicle without obtaining written permission from Saferide Car Rental. Failure to obtain written consent is considered a violation of this agreement.
10. Individuals under the age of 23, regardless of whether they possess a driver's license or not.

Liability and Insurance:

Saferide Car Rental provides several insurance options to protect you during your rental:

Collision Damage Waiver (CDW):

The car's basic damage coverage protects you if the car's bodywork gets damaged. However, Collision Damage Waiver typically has an excess, which is the amount you would have to pay towards repairs. The participation fee/deductible amount varies depending on the type of car, usually ranging from P10,000.00 to P35,000.00. CDW covers only the car's bodywork. Any damage to windows, wheels, undercarriage, interior, or personal belongings will require you to pay the full cost of repairs and any administration charges.

Supplemental Liability Insurance (SLI):

Supplemental Liability Insurance typically covers damages to other people's property, such as their cars, and medical costs for injuries in an accident. The maximum coverage for property damage is P100,000.00, and for physical injury, it is also P100,000.00.

Personal Accident Insurance (PAI):

Personal Accident Insurance provides coverage for drivers of a rental car and their passengers in case of accidental medical costs, emergency care, and accidental death during the rental trip. The coverage limit is up to P50,000.00 per person. However, it's important to note that this insurance policy does not cover injuries sustained by individuals renting motorcycles from Saferide Car Rental.

Fault and Negligence:

In the event of a vehicle accident or damage caused by a fortuitous event where the renter is not at fault or negligent, the renter is only responsible for the participation fee of the vehicle, whichever is higher, unless covered by an insurance policy. If the cost of repair, damage, and consequential liabilities are covered and recoverable from an insurance policy, it is immaterial as to whose fault or negligence caused the damage. However, if the renter is at fault or negligent in driving the car, they shall be liable for the entire amount.

Extension of Rental:

If the renter wishes to extend the rental period beyond the previously agreed return date and time, they should immediately inform Saferide Car Rental. Failure to follow the extension procedure will be considered a violation of this rental agreement.

Mechanical Failure and Damages:

Saferide Car Rental takes precautions to prevent mechanical failures. However, we shall not be liable for any mechanical failure of the vehicle or consequential damages. The renter shall not make any claims against Saferide Car Rental for delays caused by breakdowns or accidents. Repairing or changing any part of the car without the prior knowledge and written approval of Saferide Car Rental is prohibited. The renter shall be responsible for damages to the car resulting from their negligence.

Trips Outside the Province:

If the renter plans to take a trip outside the province, they must notify Saferide Car Rental in writing of their intentions. Failure to do so will make the renter responsible for all costs related to fixing any engine or mechanical trouble that occurs during the trip. Additionally, the vehicle should only be driven by an authorized driver; otherwise, the renter will be in breach of the agreement.

Release of Liability:

The renter releases Saferide Car Rental from any liability for loss or damage to any property left, stored, or transported by the renter or any other person in or upon the vehicle before, during, or after the rental period. The renter agrees to hold Saferide Car Rental harmless, defend, and indemnify against all claims and costs based on or arising from such loss or damage.

By proceeding with the rental, you acknowledge and agree to abide by the above terms and conditions.

Rental Period:

The rental period will commence upon boarding or 30 minutes after the scheduled rental time, whichever comes first. The rental period will end at the time specified in the rental agreement.

Inclusions and Exclusions of Services:

All service inclusions and exclusions are listed on the services page and must be observed by the client.

Vehicle Use:

The client agrees to use the vehicle only for the purposes specified in the rental agreement. Any additional usage must be approved in writing by our company. The client and their passengers must wear seat belts at all times while the vehicle is in motion. If the client requires additional usage, they must contact our customer support team to obtain approval.

Vehicle Passenger and Baggage Limit:

The client acknowledges that the passenger and baggage limit for each rental vehicle is subject to the manufacturer's specified capacity. The client and their passengers must not exceed the vehicle's maximum passenger and baggage limit during the rental period. It is the client's responsibility to ensure that their luggage and personal belongings fit comfortably and safely within the designated storage areas of the vehicle. Our company shall not be held liable for any loss or damage to the client's personal belongings or luggage during the rental period.

Insurance:

All vehicles are insured for passenger liability up to 50,000.00 per passenger and third-party property damage. However, personal belongings and luggage are not covered by our insurance policy.

Termination of Agreement:

Our company reserves the right to terminate the rental agreement at any time if the client breaches any of the terms and conditions outlined in this agreement.

Company Indemnification:

The client agrees to indemnify, defend, and hold harmless our company, its agents, employees, and affiliates, from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with the rental of the vehicle or the use of the services provided by our company.

Disclaimer:

While we strive to provide a safe and reliable service, our company shall not be held liable for any loss, damage, injury, or inconvenience that may occur during the rental period. This includes, but is not limited to, delays, mechanical breakdowns, accidents, or any other unforeseen circumstances. The client understands and accepts that they are responsible for their own safety and the safety of their passengers during the rental period.
